Age requirements

If you are under the age of 18, you must have your legal guardian give their permission on the entry form.


Video Guidelines

Videos that contain the following content will not be accepted:

  • • Pornographic acts or images.
  • • Nudity.
  • • Violence of any kind.
  • • Anything that demeans or discriminates against any racial or ethnic groups, age, gender, religion, or sexual-orientation.

In general, if your video could be shown in a "G-Rated" or "Family" movie, than it should be acceptable.


Privacy

Your video must be hosted only on YouTube, and must be classified as "private." (Click here to see instructions on how to do that.) Any video that has been publicly released on the Internet or through any other public distribution channel will be disqualified.


Sound Quality

In order to properly integrate your video in the editing process, we must be able to hear the song, "¡Moviendote!," playing throughout your video. However, as we will be using only the video portion of your submission, the actual quality (audio fidelity) of the sound is not important.


Expiration Date

All videos must be received by midnight, PST (pacific standard time) on Monday, February 15, 2011.


Notification

All participants who will have some portion of their video clips included in the final "¡Moviendote!" video will be informed, via e-mail or Facebook, by Monday, March 15, 2011.


Ownership

Once a video has been submitted to the "¡Moviendote!" contest, all ownership will be retained by Caroff Communications. No portion of any submitted video may be used for any purpose, without the express written permission of Caroff Communications.


Legal Requirements

General

By entering the Contest, each contestant agrees to comply with and be bound by the Rules and to comply with the rules and specifications set forth in the YouTube terms of service, which can be found at www.youtube.com/t/terms (the "YouTube Rules").

By entering the Contest, each contestant agrees to comply with and be bound by the Rules and Regulations herein and to comply with the rules and specifications as set forth herein.

Submitted videos will not be accepted or eligible, in the sole discretion of Caroff Communications, if they include any content that contains or appears to contain any inappropriate content, including but not limited to the following:

  • • Explicitly profane or obscene material

  • • Endorsing or condoning of illegal drug use, alcohol abuse or any other illegal activity

  • • Nudity, profanity or extreme or gratuitous violence

  • • Express or implied commercial endorsement

  • • Derogatory characterization of any person or group based on age, race, color, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, or the like

  • • Depictions of any inappropriate conduct, language or other context

Each contestant shall secure any necessary permission(s) to use copyrighted images, music or any other materials or information in connection with his/her video.

Each Contestant certifies that the video and its entire content that contestant submits is original and that contestant is the sole and exclusive owner of the submitted video and that contestant has the right to submit the video to the Contest. In the event the contestant shall obtain prior to subission all of the necessary legal permissions to submit the video to the Contest.

Submitted videos become the exclusive property of Caroff Communications and the contestant unconditionally assigns and transfers to Caroff Communications all rights, title, interest and claims to the video, including, without limitation, the copyright therein. Caroff Communications has the right to post, use, broadcast, display, publicly perform, alter, edit, assign, create derivative works there from or dispose of such entries in whole or in part (including clips or still frames from videos) however it sees fit in any and all media without limitation as to time or territory without approval of contestant. Contestants will sign all necessary documents granting Caroff Communications rights in videos if required by Caroff Communications.

No contestant shall, or shall have, at any time, granted any person or entity other than the Caroff Communications, the right to use contestant's video.

Caroff Communications reserves the right to disqualify any entry that Caroff Communications believes in its sole and unfettered discretion, infringes upon any law or otherwise does not comply with the Rules and Regulations or the YouTube Rules.

Review of Submissions

Caroff Communications will review submitted videos. Contestants that do not comply with the the Rules and Regulations herein will be disqualified from The ¡Moviendote! Project and their video will not be used. Decisions of Caroff Communications as to official entries are final and binding. Caroff Communications assumes no responsibility for disputes between persons claiming authorship of a submitted video.

Media Activity

By participating in the Contest, each contestant agrees and grants Caroff Communications permission to use, copy, modify and make available contestant's submission to the public for any purpose whatsoever, including but not limited to press and media communications. This permission/representation/warranty/license is in perpetuity.

Each winner agrees that Caroff Communications may use contestant's name and likeness to administer and promote the Contest.

Privacy Notice

By participating in the Contest, each contestant agrees that Caroff Communications may be required to collect from contestant some limited personal information. In the event Caroff Communications requires but cannot collect the limited personal data, a contestant may not be eligible to participate in the Contest.

Any personal information collected during the course of the Contest will only be used for administering the Contest and for other purposes as outlined in the Rules and Regulations herein, and will be subject to the practices described in The ¡Moviendote! Project's Privacy Policy.

General Conditions

This Contest is governed by the laws of the state of California, USA. In the event legal action is commenced by anyone in connection with this Contest or any of the terms of the Rules and Regulations herein, jurisdiction shall be solely within the Superior Court of the State of California, USA. By participating in the Contest, each contestant agrees to be bound by the terms of the Rules and by Caroff Communications' decisions, which are final and binding, on all matters pertaining to the Contest.

Caroff Communications is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes.

Caroff Communications accepts no responsibility for submissions lost, delayed, damaged, or mislaid, howsoever caused.

Limitations of Liability

To the maximum extent permitted by law, contestant agrees to indemnify and hold Caroff Communications harmless from any and all claims, demands, losses, legal proceedings, damages, costs and expenses and the like resulting from any act, default or omission, knowingly or unknowingly committed by contestant. In the event a claim or legal action is brought against Caroff Communications based upon the act or omission of contestant, contestant will not only indemnify and hold Caroff Communications harmless but will agree to pay attorneys' fees and court costs incurred by Caroff Communications in connection with said claim or legal action.

Severability

If any provision herein is held to be invalid or unenforceable, all remaining provisions of the Rules will remain in full force and effect.
